1. Scope of These Terms

These Terms of Service (“Terms”) govern your access to and use of OmniPostr’s platform, applications, APIs, models, integrations, documentation, and all related tools (collectively, the “Services”). By using the Services, you agree to comply with and be bound by these Terms.

If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization. In such cases, “you” refers to the organization and its authorized users.

2. Eligibility & Accounts

To use the Services, you must: (a) be at least the age of majority in your jurisdiction; (b) have the legal capacity to enter into a binding agreement; and (c) use the Services in compliance with all applicable laws.

You are responsible for keeping your login credentials confidential and for all activity under your account. You must promptly notify us of any unauthorized access or suspected breach.

You agree to provide accurate and complete information when creating or updating your account.

3. Acceptable Use Policy

You agree not to misuse the Services. Prohibited activities include, but are not limited to:

  • Violating any applicable law, regulation, or third‑party rights.
  • Attempting to bypass, disrupt, or compromise system integrity, security, or authentication measures.
  • Reverse‑engineering, decompiling, or extracting source code or model parameters.
  • Using OmniPostr outputs in deceptive ways (e.g., impersonation, misinformation, undisclosed automation).
  • Uploading malicious code, malware, or engaging in DDoS, scraping, or automated abuse.
  • Using the API at volumes or patterns that materially degrade the stability of the platform.

We reserve the right to suspend or terminate accounts that violate this Acceptable Use Policy.

4. Your Content & Generated Outputs

“Input Content” means any content you upload, paste, link, or otherwise provide into the Services. You retain ownership of your Input Content. You grant OmniPostr a limited license to process, store, and analyze Input Content solely to provide, maintain, secure, and improve the Services.

“Generated Outputs” means content generated by the Services based on your Input Content. Except where prohibited by law or indicated by your plan, you own your Generated Outputs. You are responsible for reviewing all outputs before publishing and ensuring they comply with your legal, editorial, and brand requirements.

You must not submit confidential or sensitive information unless your plan expressly supports private or encrypted processing.

5. Plans, Billing, Renewals & Cancellations

Fees, billing cycles, and resource limits (including monthly output limits) are described at omnipostr.com/pricing. By subscribing, you authorize us to charge your payment method for recurring fees until you cancel.

  • Subscriptions auto‑renew unless canceled before the renewal date.
  • Fees are non‑refundable except where required by law.
  • Overages may apply if you exceed usage limits tied to your plan.
  • You remain responsible for taxes, duties, and applicable regulatory fees.

You may cancel anytime via your account dashboard; cancellation takes effect at the end of the current billing cycle.

6. API Access & Rate Limits

If your plan includes API access, you are granted a limited, non‑exclusive, revocable license to use the API in accordance with these Terms and our API documentation.

  • You must keep API keys secure and may not share, resell, or sublicense them.
  • We may monitor usage for compliance, security, and system reliability.
  • We may throttle or limit requests if usage threatens service stability or violates policies.

7. Privacy & Data Protection

Our Privacy Policy explains how we collect, use, store, and protect your personal data. By using the Services, you consent to the data practices described therein.

For enterprise and regulated deployments, supplemental data‑processing agreements may apply.

8. Intellectual Property

OmniPostr retains all rights to the platform, software, models, algorithms, UI/UX design, branding, and documentation. You may not copy, modify, distribute, sell, or lease any part of the Services unless expressly permitted.

9. Disclaimers

The Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non‑infringement, and accuracy of outputs.

10. Limitation of Liability

To the maximum extent permitted by law, OmniPostr is not liable for indirect, incidental, consequential, special, or punitive damages; loss of profits, data, or business interruption; or any damages exceeding the amount paid in the preceding 12 months.

11. Changes to These Terms

We may modify these Terms from time to time. Updated Terms become effective upon posting. Continued use of the Services constitutes acceptance of the revised Terms.
